Personal Information Collection Statement (“PICS”) of GenieBiome Limited

1. General

The G-NiiB online store (“G-NiiB Online Store”) is operated by GenieBiome Limited (“Company” or “We”). We respect the privacy rights of visitors to the G-NiiB Online Store. We are committed to ensure that our collection, usage, processing, transmission, and storage of “Personal Data” (defined below) is carried out in compliance with the Personal Data (Privacy) Ordinance, Cap 486 of the laws of the Hong Kong Special Administrative Region (the “PDPO”).

“Personal Data” means any information relating to an individual from which it is possible to identify the individual directly or indirectly.

This personal information collection statement (the “PICS”) provides you with notice of the following on or before the Company collects your Personal Data:

(a) what Personal Data we collect from you;
(b) the purposes for which your Personal Data collected by us will be used following collection;
(c) how your Personal Data collected will be used by us (together with the ability to opt in or out of certain uses for the Personal Data we collect from you);
(d) to whom your Personal Data will be shared and transferred; and
(e) to whom you may address for sending in Personal Data access or correction requests and direct marketing consent/objection.

This PICS is provided by the Company for the purposes of complying with the notification requirements under the PDPO when collecting Personal Data.

This PICS and the PPS may be revised from time to time as the Company deems necessary. Any changes will be posted on the G-NiiB Online Store, along with the updated effective date. Our processing of Personal Data we collected about you will be governed by the most recent version of the PICS in force and effect. In the event such changes to the PICS and/or PPS require us to seek your consent or indication of no objection (e.g. proposed use of your Personal Data for a new purpose or we intend to share your Personal Data with a new type of person which is located outside of Hong Kong), we would bring this to your attention and seek your consent or indication of no objection accordingly.

The laws of certain jurisdictions / countries require us to provide you with additional information about our data processing activities. Such additional information is included as a separate addendum to this PICS. In addition to this PICS, please refer to the addendum which applies to you.


2. Personal Data We Collect

We may collect Personal Data directly from you when you receive the following services (“Services”) provided by and/or relating to the G-NiiB Online Store and/or the Company:

• registering and becoming a member of the G-NiiB Online Store;
• searching, browsing and viewing products in the G-NiiB Online Store;
• purchasing products and making payments on the G-NiiB Online Store;
• accumulating, redeeming and using membership points, rewards and shopping credits in the G-NiiB Online Store;
• viewing, following/receiving and reacting to news and promotion materials and offers of the Company and the G-NiiB Online Store through the Company’s website, G-NiiB Online Store and social media platforms/electronic channels used by the Company;
• completing an online survey; and
• communicating with us in respect of the Services of the G-NiiB Online Store through telephone, post, Short Message Service (“SMS”), electronic mail (“email”), Instant Messaging Application (e.g. WhatsApp), other electronic means and social media platforms.

We may collect the following Personal Data from you through your use of the Services: -
(a) your personal information: name, gender, date of birth;

(b) your contact information: telephone number or mobile number, user name or account name of social media platforms, email address, delivery address and billing address;

(c) your membership account details: your G-NiiB Online Store membership account details including membership points, membership ranking, privileges and benefits, historical transactions, products purchased or viewed on the G-NiiB Online Store, and balance in respect of membership points, rewards and shopping credits;

(d) your social media account details and your usage of social media platforms only to the extent they relate to the Company and/or the G-NiiB Online Store: your public profile information and your usage of social media platforms only to the extent they relate to the Company and/or the G-NiiB Online Store if on:

• Facebook – you follow, have viewed or liked our Facebook Page; you have elected to subscribe to Facebook Messenger for order update notifications, receiving our promotional materials and communicating with us;
• Instagram – you follow, have viewed or liked our Instagram posts; and you have elected to use Instagram to communicate with us;
• LinkedIn – you follow, have viewed or liked our LinkedIn posts; and you have elected to subscribe to our LinkedIn newsletter and to use LinkedIn to communicate with us;
• “X” (formerly known as Twitter) – you follow, have viewed or liked our X posts; you have elected to subscribe to our X newsletter and to use X to communicate with us;
• WhatsApp – you follow our WhatsApp channel, forward or share our posts; and you have elected to use WhatsApp to communicate with us;

(e) your payment details: details disclosed during your purchase of our products such as name, billing address, phone number (e.g. payment through PayMe), and payment card details (including card number, expiry date and security code), octopus card number, bank account details (including name, and account number) for payment processed by us. To the extent any payments are processed by other third party payment providers such as VISA Card, Master Card, Union Pay, Octopus, PayMe, Faster Payment System (“FPS”), Alipay HK, Google Pay and Apple Pay, your Personal Data will also be collected by such third party payment providers, please refer to their respective personal data collection statements and data privacy policies.

(f) your use of our Services: information about history of your use of our Services such as your product viewing history, product purchase history, history of delivery address(es) and self-pick up collection point(s); information you provided through survey or content generated by you relating to product reviews, comments, enquiries, responses or other content you submit on the G-NiiB Online Store;

(g) your use of the G-NiiB Online Store: details of your visits to the G-NiiB Online Store and other information collected through cookies, device’s geolocation and other tracking technology (provided that you have given your consent) such as language preference, behaviour data, and browsing history;

Your provision of Personal Data to us is entirely voluntary. However, certain Personal Data are required for:

• signing up as a member, particularly your name, contact phone number, email addresses, gender, and birthday if you wish to receive birthday credits, and
• shopping on the G-NiiB Online Store, particularly your name, contact phone number, delivery address or self-pick up collection point.

If you fail to provide the required Personal Data, we may not be able to sign you up as a member, fulfill your purchase order, or offer a Service. As you visit the G-NiiB Online Store or the Company’s website, we will guide you with appropriate information (e.g. marking certain required information with an asterisk) which Personal Data is required for performing the Service you are requesting.

If you are under the age of 18 (or considered a minor under the applicable law), you should obtain consent from your parent or guardian before you provide us with your Personal Data.

If you provide us with information about other individuals, you must tell those individuals and let them know where they can find a copy of this PICS and our PPS.

3. Purposes and Use

Your Personal Data collected by us will be used by us in accordance with your consent or indication of no objection (if required) and preferences (if indicated) for the following purposes:

(a) To manage your membership on the G-NiiB Online Store
To manage your membership of the G-NiiB Online Store, we may use your Personal Data for facilitating the creation of your membership account with G-NiiB Online Store via its website, amending any information of your membership account, operating and facilitating your participation in the membership rewards programme, determining and verifying your eligibility for discounts and promotions, managing and recording your accrual member points, shopping credits, membership rank, and redemption activities, delivery of benefits and privileges associated with your interest and requested Services in order to enable you to receive the benefits and privileges as a member as well as the Services.

(b) To personalise the Services and provide the Services to you
To personalise the Services and provide the Services to you, we may use your Personal Data for verifying your identity and identifying with the membership account you hold with us, enabling the provision of Services to you, processing billing and payments due from you, processing payment instructions from you, tracking status of the requested Service and sending you notifications in connection with the Services you requested, customising the G-NiiB Online Store’s website to your particular preferences, making suggestions and recommendations to you in relation to the Services or goods and services that may match your preferences and interests, storing your Personal Data so you do not have to re-enter those Personal Data each time you shop on G-NiiB Online Store or manage your membership account, tailoring our communication with you via different channels, including email, telephone, SMS, Instant Messaging Application (e.g. WhatsApp), other electronic means, and social media platforms.

(c) For customer services
We may use your Personal Data for providing customer services to you, communicating with you by email, post, telephone or other means, handling and following up with your complaints, comments and enquiries in relation to the Services, conducting investigation, research and/or analysis in relation to your complaints, comments and enquiries in relation to the Services, and handling any claims, actions and/or legal proceedings against the Company.

(d) For marketing purposes
With your consent, we may use your Personal Data for marketing and promotional purposes, including sending you updates on the latest news, offers and promotions in relation to the Services and the products and offers promoted jointly by the Company and other partners/advertisers which we think you may be interested, by post, email, telephone, SMS, or through social media platforms which you have subscribed to or our social media page(s) you have followed (on Facebook, WhatsApp, Instagram, LinkedIn and X), personalising the Services and the website(s) of G-NiiB Online Store which match your preferences and interests. Please refer to Section 5 (Direct Marketing) below for further details.

We may also use your Personal Data to analyse our customers’ preferences and market trends in relation to the Services and to enhance the existing Services (with your consent), conducting research, statistical analysis and behavioral analysis, customer profiling and analysing your purchasing preferences; compiling aggregate statistics on G-NiiB Online Store’s website usage as well as your social media platform (i.e. Facebook, WhatsApp, Instagram, LinkedIn and X) usage only to the extent they relate to the Company and/or the G-NiiB Online Store.

(e) To comply with legal obligations and for legal and administrative purposes
We may also use your Personal Data to comply with our legal obligations, including but not limited to making disclosures or taking actions as required by applicable laws, rules and regulations, codes of practice, or guidance notes binding on the Company.

We may also use your Personal Data for legal and administrative purposes, including verifying and processing payment, preventing and detecting fraud, screening against money laundering and other criminal or unlawful activities, accounting, billing and audit purposes, handling claims, actions and/or legal proceedings against the Company and exercising, enforcing or protecting the legal rights of the Company.

The Company will retain your Personal Data for the duration of your membership and the period required to comply with applicable laws of limitation or if otherwise required under applicable laws in Hong Kong.

4. Who We Share Your Personal Data with

In order for us to provide the Services and operate our business, we will share your Personal Data with certain persons (described below) who may not be located in Hong Kong. As a result, your Personal Data will be transferred to, held or processed at a jurisdiction outside Hong Kong, where your Personal Data may not be protected to the same or similar level in Hong Kong. We will take all reasonable and practical steps to ensure that your Personal Data will be handled outside Hong Kong in a manner that would not contravene the PDPO:

(a) any agent, contractor or third party service provider who perform services on behalf of the Company, such services include provision and management of online store, product inventory management, provision and management of membership programme as well as customer and membership support, omnichannel marketing, website hosting, cloud storage, cloud related services, information technology support, data processing, payment processing and authorisation, order fulfillment, logistics and delivery, customs clearance, and provision of administrative, telecommunication, computing or other services to support the operations of the business of the Company;

(b) any governmental agency, regulatory authority, law enforcement agency, court or judicial body for the purposes of complying with the legal obligations of the Company;

(c) any person under a duty of confidentiality to the Company, including accountants, auditors, legal advisers and other professional advisers for the purposes of supporting the ordinary course of business of the Company as well as supporting any corporate re-organisation and transactions; and

(d) the holding company/ companies of the Company and its subsidiaries.

Please note that we rely on some agents, contractors or third party service providers, in particular in the provision and management of online store and payment gateways (whose servers and systems may be located outside Hong Kong) to perform substantially the Services. As a result, your Personal Data will be transferred and processed in a jurisdiction outside of Hong Kong. If you do not consent to the transfer of your Personal Data to a jurisdiction outside of Hong Kong, we will not be able to provide you with any of the Services (including signing up as a member and logging in to or using the G-NiiB Online Store).

5. Direct Marketing

Subject to obtaining your consent (as set out below), the Company intends to use your name, delivery address, mobile phone number, email address, username or account name of social media platforms (such as Facebook, WhatsApp, Instagram, LinkedIn and X) for the marketing subjects/purposes stated below:

• sending or showing you updates on latest news about our Company and our products;
• sending or showing you the latest promotional offer of our products;
• sending or showing you information on our membership programme, such as member points, shopping credits and birthday gifts;
• sending or showing you information on products and other offers promoted jointly by us with other partners/ advertisers which we think you may be interested;
• sending or showing you educational materials, such as blogs, news, sharing; and
• sending or showing you company activities, such as polling events.

We shall not so use your Personal Data unless we have received your consent for us to do so. Consent once given by you shall remain valid until you withdraw it by requesting us to cease to so use such Personal Data in direct marketing.

You have the right to withdraw or give consent for our use of your Personal Data in direct marketing from time to time. You may in the future change your preferences previously given to us by sending us requests (free of charge to you) for updating your new preferences relating to direct marketing. Such requests should be sent to the attention of the Company’s Personal Data Officer. Contact details are set out in Section 9 of this PICS.

6. Cookies

A cookie is a small text file (of information) a web server generates and send to a web browser when you access the G-NiiB Online Store. A cookie is stored on the web browser on your computer (or other electronic device) you use to access the G-NiiB Online Store. We use cookies on the G-NiiB Online Store to:

• recognise you whenever you visit the G-NiiB Online Store;
• obtain information about your preferences, viewing and browsing behavior, online movements and use of the Internet;
• keep track of the items stored in your shopping basket and take you through the checkout process;
• carry out research and statistical analysis to help improve our Services and to help us better understand our visitor and customer requirements and interests;
• target our marketing and advertising campaigns and those of our business partners and advertisers more effectively by providing interest-based advertisements that are personalised to your interests;
• make your online experience more efficient and enjoyable; and
• enable tighter security.

The information we obtain from our use of cookies may not contain your personal data. Although we may obtain information about your computer or other electronic device such as IP address, browser settings, browsing history, and/or other Internet log information, this may not be able to identify you personally. To the extent that non-personal data is combined with Personal Data, we treat the combined data as Personal Data for the purposes of this PICS.

If you want to disallow the use of cookies, you can do so on your own web browser. Depending on the types of cookies disabled, you may not be able to use some of the functionality of the G-NiiB Online Store.

7. Links to Other Websites

The G-NiiB Online Store may provide links to other external websites. By clicking on such link, such as clicking on the banner of the Company or MicroSigX, you are leaving the G-NiiB Online Store. This PICS only applies to the G-NiiB Online Store. The Company does not have control over any Personal Data or other information you give to any other entity after you have left the G-NiiB Online Store. You are advised to refer to the respective PICS and privacy policies of these external websites for more information.

8. Your Right to Access and Correction of Personal Data

You have a right, at any time, to request access to and correction of your Personal Data in any of our records. To exercise any of your rights, please reach us per contact details set out below. For making data access request, please complete the Data Access Request Form (the “Form”) specified by the Privacy Commissioner for Personal Data under section 67(1) of the PDPO.

We may require you to provide identity proof such as your Hong Kong Identity Card. Your right of access includes the right to obtain a copy of your Personal Data requested in the enquiry. The Company reserves the right to charge you a fee for complying with a data access request as permitted by the PDPO. We will respond to your request within 40 days after receiving it.
